We have very pretty strict laws about clubs and bars serving people that are intoxicated. There is a certain limit of alcohol consumption that can be served to patrons, and yeah it varies between premises. This is generally up to the discretion of the bar staff. But have you ever seen someone that has been at a pub all afternoon or a club all night drinking red bull? Well I sure have and it’s a funny site, they practically bounce off the walls. And seriously I mean how bad for your health can that be??
I find it quite amusing that Red Bull has just successfully won a case it brought against two New South Wales nightclubs which were unlawfully substituting its own brand for energy drink.
The Havana nightclub and Bloc nightclub had engaged in misleading and deceptive conduct by unlawfully substituting another product when customers asked for Red Bull.
Substitution is an increasing problem in bars, pubs and clubs for Red Bull, where-by cheaper products are deliberately given to customers asking for Red Bull without informing them, and still being charged a premium price.
Red Bull took the unusual step of taking the matter to court after reported incidents of the practices rose.
Apparently it is the first time that Red Bull has taken court action to defend its brand against the practice of substitution. But one would wonder, could this open a can of worms in general about the Red Bull product being served excessively in public venues. There are some clubs (such as RSL clubs) that don’t sell the product at all.
“Red Bull is totally committed to protecting its brand and the rights of its consumers. The latest action demonstrates that we will vigorously pursue those people we see as infringing the rights of the Red Bull brand and those of our valued consumers”, said Janelle Neath, head of communications at Red Bull.
